The Additional Chief Judicial Magistrate court in Ernakulam has asked the police to hand over Pulsar Suni and Vijeesh, accused in the abduction and alleged rape of a Malayalam actor to the Nedumbassery police, under whose jurisdiction the case was registered.
The order comes in the wake of Pulsar Suni and Vijeesh’s advocate Krishnakumar filing a petition in the court stating that the accused were arrested by the Central police when the duo had arrived at the court to surrender before the magistrate.
Although the petition requested that the two accused be brought back to the same court, the Additional Chief Magistrate Siju Shiek said in his order, that the police does not have to do so.
"But petition and statement of complainant prima facie would show that the said accused were removed from this court. Since no crime is pending before them in this court, a direction to produce them back is unnecessary," reads the order.
Speaking to The News Minute, Advocate Krishnakumar's team said that they filed two petitions against the police action.
"One petition is demanding that the accused be brought to the same court from which they were arrested. The second one is against the police inspector for having committed contempt of court by entering the magistrate court and forcefully arresting the accused."
On Thursday afternoon, Pulsar Suni and Vijeesh reached the court to surrender before the magistrate, but ended up being arrested by the police, as the magistrate was not in his chamber. Soon, criticism rained down on the police, for having used force inside the court to arrest the two accused.
