Karnataka HC halts encroachment demolition at Bagmane tech park

The Bruhat Bangalore Mahanagara Palike (BBMP) has been ordered by the Karnataka High Court not to take coercive action against Bagmane Tech Park regarding the alleged encroachment of stormwater drains (SWDs) until it has had a chance to respond to the report of the survey on the encroachments of SWDs conducted by the Assistant Director, Land Records and Survey Settlement.

Justice Hamant Chandangoudar issued the order, disposing of the petition by Bagmane tech park, which alleged that BBMP officials were attempting to tear down the tech park's compound walls by giving oral instructions without conducting any survey or giving prior notice regarding the alleged encroachment of SWDs.

According to the petition, allegations of SWD encroachment were made against the owners and developers of the nearby Purva Parkridge residential housing complex, which was built by Puravankara Projects Pvt Ltd, more than ten years ago. Several notices were also sent to these parties.

The petitioner asserted that it reported to the BBMP about flooding in its tech park in June 2022 as a result of Purva Parkridge's encroachment of SWDs. In August 2022, the High Court ordered the BBMP to undertake a new survey after receiving complaints from the owners of some villas in that residential area that the study had been done without their prior knowledge. It further claims that BBMP officials informed them orally on September 9, of their plan to tear down the compound wall because it allegedly encroaches SWD.

In addition, Shashikiran Shetty, who represented Bagmane, said that they would offer to remove the encroachment if a survey revealed that the petitioner was guilty of it. The petitioner claims that the commercial building on the scheduled land was built in accordance with the approved plan and hasn't deviated from it.
