Hyd woman given instant triple talaq, allegedly for ‘having crooked teeth’

Police will seek legal counsel before making an arrest under the triple talaq Act.

Yet another case of a man giving triple talaq emerges from Hyderabad, this time the man allegedly gave the triple talaq as his wife had crooked teeth. The police have booked dowry harassment and triple talaq cases against the accused husband and his family.

The woman who had first filed a police complaint on October 26 against her husband Mohammad Mustafa and her in-laws for dowry harassment told media, "On October 1, Mustafa came to my place and said that he would not take me back with him. He abused my parents and pronounced instant triple talaq.”

 The woman has alleged that Mustafa and his family had demanded dowry at the time of their wedding, and her family had met their demands. The woman's family shelled out five lakh rupees and five tolas of gold as dowry. However, after the wedding, Mustafa and his family allegedly began harassing her to bring more dowry, in the form of money and gold. The woman also accused her husband of taking away her brother’s bike before their wedding in June this year and never returning it.

In her complaint to the police, she stated that before the wedding, her father-in-law had told her family that Mustafa ran a clothing business in Madina, Saudi Arabia and was well settled. Only after marriage, she got to know that her husband was an auto driver.

"They used to torture me regularly and finally Mustafa said that he does not like me because of my crooked teeth and that he did not want to live with me anymore. My in-laws locked me inside their house for 10 to 15 days," she alleged, speaking to ANI. In her complaint to the police, the woman has alleged mental and physical torture at the hands-on her in-laws.

Both families tried for a compromise, however, on October 1, Mustafa allegedly divorced her with instant triple talaq.

The Kushalguda police under the Rachakonda commissionerate in Hyderabad has booked cases against Mustafa under the Dowry Act and the triple talaq Act. Speaking to TNM, the Kushalguda Inspector said, "We have not yet arrested the husband. Concerning the triple talaq Act, we will be taking legal advice before taking any action,"

The Supreme Court had declared instant triple talaq to be illegal in 2017 and in July this year, the Muslim Women (Protection of Rights on Marriage) Act, 2019 was passed. Instant triple talaq is now a crime with three years imprisonment.

Section 3 of the Act makes the pronouncement of instant triple talaq by the Muslim husband, by words, either spoken or written or in electronic form or any other form, void and illegal. According to section 4, the husband who pronounces instant triple talaq shall be punished with up to three years imprisonment and will be liable to fine.
